ADDITIONAL DETAILS
1. Booking Amount & Provisional Allotment — The booking amount of ₹ 2,00,000/- paid by the allottee is solely towards provisional allotment of a specific plot and shall not, by itself, confer any ownership rights, title, or interest in the said plot. Ownership rights shall be transferred to the allottee only upon execution and registration of the Sale Deed. Payment timeline: On Booking (A) ₹ 2,00,000; Within 7 days of booking (B) 25% of sale consideration (less amount paid in A); Within 15 days of booking along with Agreement of Sale (C) 40% of sale consideration (less amount paid in A+B); Remaining payments as per payment schedule in the Agreement of Sale.
2. Stamp Duty, Registration & Other Charges — In addition to the plot cost, the allottee shall be liable to pay applicable charges towards stamp duty, registration fees, legal fees, and all other statutory charges as indicated in the cost sheet or as applicable at the time of registration/sale agreement. Such charges shall be payable on demand and at actuals. The allottee shall make all payments towards the plot, common areas, and associated facilities in accordance with the payment schedule provided by the Developer.
3. Taxes & Government Levies — Applicable Goods and Services Tax (GST) and any other statutory taxes, duties, cesses, or governmental levies shall be payable by the allottee at prevailing rates, as amended from time to time. Any increase in existing taxes or introduction of new levies by the Government during the contract period shall be borne solely by the allottee.
4. Payment Obligations & Delay Charges — All payments shall be made within the timelines specified in the cost sheet. Any cheque dishonour charges/banking charges arising due to delayed or failed payments shall be recoverable from the allottee along with applicable interest. Any delayed payment shall attract interest at the prevailing highest Marginal Cost of Lending Rate (MCLR) of the State Bank of India plus 2% per annum.
5. Cancellation by Developer — In the event of non-payment as per the payment schedule or failure by the allottee to execute, register, and return the Agreement to Sell within 15 (fifteen) days from the date of booking or within any approved extension period, the Developer shall have the right to cancel the booking, refunding the balance amount and withholding ₹ 50,000/-. The terms and conditions contained in this booking form shall remain valid only until execution of the Agreement to Sell, after which the terms of the Agreement to Sell shall prevail.
6. Validity of Booking — The booking shall be deemed valid only upon realization of the booking amount and execution of the booking form by the allottee or by the holder of a valid registered Power of Attorney. Delivery of the Agreement to Sell by the Developer shall not create any binding obligation unless: (a) the allottee completes legal due diligence, initial payment and obtains the loan sanction letter, wherever applicable, within 15 (fifteen) days from the date of booking; (b) the allottee signs and returns the Agreement to Sell along with all schedules, annexures, and applicable payments within 15 (fifteen) days; and (c) the allottee appears before the concerned Sub-Registrar for registration as and when intimated by the Developer, wherever applicable.
7. Installment Payments — The allottee shall pay all installments as per the cost sheet within 7 (seven) days from the date of demand raised by the Developer. Delayed payments shall attract interest as specified in Clause 4 above. Payments shall be made only through account payee cheque, demand draft, or direct bank transfer in favour of the Developer, payable at Bengaluru. All payments towards the booking and sale of the plot shall be made directly by the allottee. Payments made by any third party on behalf of the allottee shall not be accepted or recognized by the Developer.
8. Cancellation by Allottee — If the allottee chooses to cancel the booking within 15 (fifteen) days from the date of signing the booking form, the entire booking amount shall be refunded within 30 (thirty) days from the date of receipt of written cancellation intimation along with the required supporting details. In the event of cancellation for any reason after 15 (fifteen) days from the date of booking, a cancellation charge of ₹ 50,000/- shall be applicable, and the balance amount shall be refunded within 30 (thirty) days from the date of cancellation. If the allottee fails to pay the full booking amount of ₹ 2,00,000/- within 15 (fifteen) days from the date of booking, the booking shall automatically stand cancelled and any amount paid shall be liable for forfeiture.
9. Specifications — Requests for changes or modifications to the standard specifications shall not be entertained.
10. Clubhouse Membership — Clubhouse membership is mandatory for all allottees. Applicable clubhouse charges shall be payable as per the payment schedule mentioned in the cost sheet.
11. Tax Deducted at Source (TDS) — TDS at the rate of 1% shall be applicable on the Sale Agreement value cost exceeding ₹ 50,00,000/-, in accordance with applicable provisions of the Income Tax Act - 194 IA.
